column_border_width=&#8221;none&#8221; column_border_style=&#8221;solid&#8221;][vc_column_text css=&#8221;&#8221; text_direction=&#8221;default&#8221;]Il 17 aprile 2026 il Garante Privacy ha pubblicato il\u00a0Provvedimento n. 284 sull&#8217;<a href=\"https:\/\/www.garanteprivacy.it\/home\/docweb\/-\/docweb-display\/docweb\/10241943\" target=\"_blank\" rel=\"noopener\">uso dei tracking pixel nelle\u00a0email<\/a>.<\/p>\n<p>Pubblicato in Gazzetta Ufficiale il 29 aprile 2026, fissa un termine di adeguamento di 6 mesi: entro il <strong>29 ottobre 2026<\/strong> ogni azienda che usa questi sistemi di monitoraggio nelle email dovr\u00e0 essere in regola.<\/p>\n<p>Se gestite <strong>newsletter<\/strong>, <strong>DEM<\/strong> o <strong>campagne di email marketing<\/strong>, questo provvedimento vi riguarda direttamente.<\/p>\n<p>Ecco una sintesi di cosa prevede e cosa fare.[\/vc_column_text][\/vc_column][\/vc_row][vc_row type=&#8221;in_container&#8221; text_direction=&#8221;default&#8221;]Il <strong>tracking pixel<\/strong> \u00e8 una minuscola immagine, invisibile all&#8217;occhio umano, che si carica automaticamente quando un destinatario apre un&#8217;email. Il Garante suggerisce di usare pixel identici per tutti i destinatari della stessa campagna, in modo che il dato non sia riconducibile al singolo indirizzo.<\/li>\n<li><strong>Sicurezza e autenticazione<\/strong>: quando il pixel serve a verificare che un&#8217;email sensibile (reset password, conferma account, riscontro a una richiesta legata ai diritti GDPR) sia stata aperta su un dispositivo noto all&#8217;utente.<\/li>\n<li><strong>Comunicazioni obbligatorie per legge<\/strong>: notifiche di data breach, variazioni contrattuali, comunicazioni istituzionali: casi in cui l&#8217;invio \u00e8 un obbligo giuridico e sapere se il messaggio \u00e8 stato ricevuto \u00e8 funzionale a quell&#8217;obbligo.<\/li>\n<\/ol>\n<p>Fuori da questi tre casi, quindi <strong>nella quasi totalit\u00e0 delle campagne di marketing e delle newsletter, il consenso resta necessario<\/strong>.[\/vc_column_text][\/vc_column][\/vc_row][vc_row type=&#8221;in_container&#8221; text_direction=&#8221;default&#8221;]Una buona notizia per chi gestisce moduli di iscrizione: il Garante ammette che <strong>un solo consenso informato possa coprire sia la ricezione delle comunicazioni promozionali sia il tracciamento tramite pixel<\/strong>, senza bisogno di richieste separate.<\/p>\n<p>Questo \u00e8 possibile a condizione che:<\/p>\n<ul>\n<li>la formula sia chiara e neutra, senza forzature;<\/li>\n<li>l&#8217;informativa privacy specifichi che le email conterranno sistemi di tracciamento;<\/li>\n<li>l&#8217;utente possa in ogni momento <strong>disattivare solo il tracciamento<\/strong>, continuando a ricevere le email.<\/li>\n<\/ul>\n<p>Quest&#8217;ultimo punto, la cosiddetta <strong>revoca granulare<\/strong>, \u00e8 uno degli obblighi pi\u00f9 operativi del provvedimento: bisogna offrire due opzioni distinte, non una sola.<\/p>\n<p><b>L&#8217;utente deve poter scegliere tra disiscriversi del tutto oppure continuare a ricevere le comunicazioni senza essere tracciato.<\/b>[\/vc_column_text][\/vc_column][\/vc_row][vc_row type=&#8221;in_container&#8221; text_direction=&#8221;default&#8221;]<strong>Per i trattamenti gi\u00e0 in corso, il Garante non richiede una nuova raccolta del consenso<\/strong>: basta aggiornare l&#8217;informativa privacy in occasione del primo invio utile (o del primo momento utile disponibile) e attivare, in parallelo, un meccanismo di revoca granulare per chi \u00e8 gi\u00e0 in lista.<\/p>\n<p>\u00c8 una misura transitoria: verr\u00e0 superata man mano che i nuovi iscritti daranno un consenso unico fin dall&#8217;inizio.[\/vc_column_text][\/vc_column][\/vc_row][vc_row type=&#8221;in_container&#8221; text_direction=&#8221;default&#8221;]Per arrivare pronti alla scadenza del 29 ottobre 2026, ecco le azioni da mettere in agenda:<\/p>\n<ul>\n<li><strong>Aggiornare l&#8217;informativa privacy<\/strong>, aggiungendo una sezione dedicata ai tracking pixel (dati raccolti, finalit\u00e0, conservazione, modalit\u00e0 di revoca).<\/li>\n<li><strong>Creare un centro preferenze<\/strong> raggiungibile dal footer di ogni email, dove l&#8217;utente possa gestire separatamente iscrizione e tracciamento.<\/li>\n<li><strong>Rivedere i form di iscrizione<\/strong>, rendendo esplicita la presenza dei sistemi di monitoraggio nel testo accanto alla casella di consenso.<\/li>\n<\/ul>\n<p>Con l\u2019occasione, raccomandiamo sempre di fare <strong>pulizia del database<\/strong>, eliminando i contatti privi di un consenso documentato, indipendentemente dalla questione pixel.[\/vc_column_text][\/vc_column][\/vc_row][vc_row type=&#8221;in_container&#8221;
